Slimming and Health - Slimmer of the Year Terms and Conditions
- Information on how to enter and prizes form part of these Conditions of Entry. Participation in this promotion is deemed acceptance of these Conditions of Entry. Entry is open to all residents of Australia who are in a healthy weight range after sensibly losing a "life changing" amount of weight in a healthy way. Employees of the Promoter members of their immediate families and agencies associated with this promotion are not eligible to enter. The promoter is: ACP Magazines of 54 Park Street, Sydney NSW 2000. ABN 18 053 273 546. There are 3 components in this competition.
- Component one - Entry
The Promotional period for component one of this competition commences on 16/04/2008 at 9am (EST) and closes last mail received on 25/06/2008
To enter the competition participants must be in a healthy weight range after sensibly losing a "life changing" amount of weight in a healthy way, no diet pills or crash dieting. Participants are required to complete the official SOTY entry coupon as found in Slimming & Health magazine and then provide a minimum of three full length before photos and a minimum of three full length recent after photos with their entry. Please write your name and address on the back of each photo. Participants are also required to submit an entry of 500 – 800 words answering the following questions; a) How/Why you put the weight on? b) What was the inspiration to lose the weight? c) The difficulties encountered? d) How the weight was lost? e) How losing the weight has changed your life?
Entries are to be mailed to: Slimming & Health SOTY 2008, PO Box 432, Eastern Suburbs MC, NSW 2004. The Promoter takes no responsibility for any late, lost or misdirected mail. The promoter cannot return photos and information to any applicants.
Entries will be judged and ten finalists will be selected by a panel of judges at Slimming & Health magazine, level 9, 175-183 Castlereagh Street, Sydney NSW 2000., Judging will begin at 10am on 30/06/08. Entries will be judged based on individual story, amount of weight lost, time period of weight lost and the healthy nature of weight loss. This is a competition based on skill and chance plays no part in selecting the winner or finalists. The finalists will be notified by the Slimming & Health office on 30/06/08,Finalists will each have their entry photograph featured in the August issue of Slimming & Health magazine, on sale 16/08/2008.
- Component two
Component two of this competition involves the selection of the final ten.
The 10 finalists will be previewed in the August issue of Slimming & Health. Readers will be given the opportunity to vote to decide who they think should be the 2008 Slimmer of the Year. The 4 finalists which receive the highest number of votes, in conjunction with deliberation from the Slimming & Health judging panel at level 9, 175-183 Castlereagh Street, Sydney NSW 2000, will be deemed the final four. The final four will be notified in the last week of July.
Readers can vote for their favourite entrant by sending an email to slimmeroftheyear@acpmagazines.com.au or by writing their choice on the back of an envelope and mailing to Slimmer of the Year, Slimming & Health, PO Box 432, Eastern Suburbs MC, NSW, 2004.
The final four must be available during the first week of August to fly to Sydney (if applicable) for the finalist’s photo shoot.
Each of the four major finalists will receive return flights for themselves only, to Sydney from their closest capital city (maximum value of $1500 – depending on point of departure). One night’s 4-star accommodation to the maximum value of $370 per night. Additional spending money, meals, insurance, taxes, passports, visas, travel to and from departure point, and all other ancillary costs are the responsibility of the winner. If the winner is a resident of Sydney, the flight component of the prize will not be included.
- Component three
Component three of this competition involves selection of the overall 2008 Slimmer of the Year winner.
The finalist, selected from the final four will be determined by the Slimming & Health judging panel at level 9, 175-183 Castlereagh Street, Sydney NSW 2000.
- Component four
Component four of this competition occurs on the 17/09/2008 and involves the announcement event
The four finalists will be required to be available on and including 16/09/08 to 17/09/08 to fly to Sydney (if applicable) for an announcement event and publicity.
Each of the four major finalists will receive return flights for themselves only to Sydney from their closest capital city to the maximum value of $1500. One night 4-star accommodation to the maximum value of $370. Additional spending money, meals, insurance, taxes, passports, visas, travel to and from departure point, and all other ancillary costs are the responsibility of the winner.
The total prize pool for each major finalist is a maximum of $1870.00.
The winner will be notified at the announcement event on the 17th of September 2008.
The winner of Slimming & Health Slimmer of the Year 2008 will receive a 7-day luxury health holiday at Fountainhead Organic Health Retreat for themselves and a friend. The accommodation includes a deluxe cabin where the winner and a friend will be required to take the package at the same time and share the cabin. All meals are included as are group fitness activities and a 2 hour massage for the winner and chosen partner. As well as access to the Maleny baths. Economy class travel requirements from the winner’s closest capital city to the Fountainhead Organic Retreat will be included in the prize.
- The winner of the Slimming & Health Slimmer of the Year 2008 and other three finalists will also appear in the October 2008 issue of Slimming & Health, on sale 17/09/2008
- By accepting the Prize, the Winner agrees to participate and co-operate as required in all editorial activities relating to this promotion and the redemption of the Prize, including but not limited to being interviewed, photographed, filmed and/or chaperoned throughout the duration of the Prize and the Winner will not be entitled to any fee for such use.
- By entering the competition, and by collecting a prize, the winners acknowledge and accept that driving, travel and any other activities comprising the prize, are inherently dangerous and may result in death, injury, incapacity, damage to property or other losses. The winners, for themselves and their executors, releases the Promoter, its agents, officers and employees, from any and all legal claims in connection with any death, injury, incapacity, damage to property or other losses arising from or connected with the collection or enjoyment of the prize. Where the prize involves driving or travel, before being eligible to collect a prize, all winners under 18 years old must provide to the Promoter proof of age and the full name, address and telephone number of the winner’s parent /legal guardian. Before a winner is eligible to collect a prize, the parent /legal guardian will be required to sign a release, in terms of the release given by the winner above. The release will also require the winner’s parent /legal guardian to accept responsibility for the acts and forbearances of the winner. Failure to provide such proof, particulars or releases will immediately invalidate the winner’s entitlement to the prize. Prizes are not transferable or redeemable for cash.
- The judges’ decision in relation to any aspect of the competition is final and binding on each person who enters. Chance plays no part in determining the winner. No correspondence will be entered into.
- The winner will be notified by the editor of Slimming & Health, Kate Fitzpatrick, on 17/09/2008 at the Announcement Event.
- Entries remain the property of the Promoter and cannot be returned. The entries may be entered into a database and winners can be used for future promotional, marketing or publicity purposes, subject to the law of privacy. Promoter reserves the right to publish photographs of winners. All entries become the property of the promoter. All entries (including photos) submitted become the property of the promoter. Entries will not be returned to any entrant. As a condition of entering into this promotion, each entrant agrees to assign all of their rights, title and interest in and to their entry to the promoter. Each entrant warrants to the Promoter that each entry submitted is a photo of the entrant which does not infringe the rights of any third party. The entrant agrees to indemnify the promoter against all claims and costs by third parties arising from a breach of the warranty set out in this condition. The promoter is entitled to use any of the entries submitted for any purposes at its discretion, including for any future promotion, marketing and publicity purposes. The Promoters reserve the right to verify the validity of entries and entrants (including but not limited to an entrants identity, age, place of residence) and to disqualify any entrant for tampering with the entry process or for submitting an entry which is not in accordance with these Conditions of Entry. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
- Prize winners are advised that Tax implications may arise from their prize winnings and they should seek independent financial advice prior to the acceptance of the prize.
- The Promoter and its agencies and companies associated with this promotion will take no responsibility for prizes damaged in transit.
- In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.
- Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorized access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoters) due to any reason beyond the reasonable control of the Promoters; (d) any variation in prize value to that stated in these Conditions of Entry; (e) any tax liability incurred by a winner or entrant and/or (f) redemption of the prize; By entering the competition, the entrant consents to receipt of any email regarding the competition, and other emails which inform the entrant of the Promoter’s other publications, products, services and events and to promote third party goods and services it may be interested in. Prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be taken as cash. In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize. The prize is valued in Australian dollars. The Promoter accepts no responsibility for any variation in the prize value. Prize winners are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize. In the event that a portion of the prize is awarded to the winner in the form of a voucher/ ticket/ pass, redemption of that portion of the prize will be subject to the terms and conditions stipulated on the voucher/ ticket/ pass. The Promoter will not be liable for any voucher /ticket/ pass that has been lost, stolen, forged, damaged or tampered with in any way.
