Terms and Conditions

Magshop is a web service operated by ACP Magazines Pty Ltd & ACP Media that makes it easy for you to subscribe to magazines using the internet. By clicking "Pay Now" on your subscription order form and agreeing to purchase a subscription on the http://www.magshop.com.au site (Magshop Site), you:

1. Instruct Magshop to supply the contact information and order details you entered on the subscription form to the publisher of each magazine for which you have requested a subscription.
2. Acknowledge that prices quoted are inclusive of delivery costs. You also understand that 'tip-ons' and gifts that may be available with non-subscriber copies may not be provided with subscriber copies, depending on publisher's discretion.
3. Agree that any errors made in entering the contact information and order details on the subscription form are your responsibility and neither Magshop nor the publisher of the magazine is liable for any consequences of such errors or incorrect information, including but not limited to failure to send the magazines subscribed for to the correct address. If you change address or any other relevant details, you must notify Magshop.
4. Agree that all information about any magazine on the Magshop Site is provided by the publisher of that magazine and that Magshop has no responsibility for the accuracy of that information and is not liable for any errors or omissions in that information. You agree that the magazines offered through the Magshop Site are offered by the publisher of those magazines, and that any contract for the subscription for a magazine is between you and the publisher of that magazine and that Magshop is not a party to that contract.
5. Agree that Magshop and its employees and agents will not be liable to you or any other person for any loss, injury or damage arising from or as a consequence of any act or omission by Magshop or any person providing services through the Magshop Site.
6. May unsubscribe to a magazine subscribed to on the Magshop Site at any time during the subscription. Simply notify Magshop by emailing magshop@magshop.com.au detailing your name, order number, item to be refunded and reason for the refund and the name of the magazine, and the request will be actioned within 5 working days. You will receive a refund of the proportion of the cost of subscription relating to those magazines not sent to you prior to the date that your request is actioned. Your refund request will be forwarded to the publisher and this refund will be paid to the credit card used to purchase the original order. If the card is no longer valid (eg, it has expired) a cheque payment will be issued. The cheque will be sent to the address nominated by you. Cheques may take up to 3 weeks. Please note, the timing and methods may vary according to each publisher.
7. In no circumstances will you receive a refund for a magazine received by you. If you have any queries regarding delivery of magazines ordered by you, you should contact magshop@magshop.com.au. The publisher is responsible for delivery of the magazines ordered by you.
8. Agree that all offers made, contracts concluded and services provided through the Magshop Site shall be deemed to be made and provided in Australia notwithstanding the location of you or the publisher of any magazine, shall be governed exclusively by Australian law, and the Courts of Australia shall have exclusive jurisdiction to determine any such matters involving or alleged to involve Magshop.
9. Agree that your name, address and email address shall when provided by you become the property of ACP Magazines Pty Ltd & ACP Media. You agree to the Magshop Privacy Policy contained on the Magshop Site.
10. Agree that if you subscribe to a magazine which is not published by ACP Magazines Pty Ltd & ACP Media, your name, address and email address shall when provided by you also become the property of the relevant publisher. You agree to contact the relevant publisher for details of its privacy policy.
11. Consent to (a) the receipt of emails from Magshop containing information and offers about products and services available on Magshop in which you may have an interest, and (b) the receipt of emails from publishers of magazines available on Magshop, containing information and offers about their products and services
12. Acknowledge that these Standard Subscription T&Cs may be modified from time to time, and agree that you are responsible for regularly reviewing these Standard Subscription T&Cs, and you agree to any such modification.
13. Agree that, to the extent permitted by law, Magshop and/or its suppliers exclude all liability for any direct, indirect, punitive, incidental, special, consequential damages, or any damages whatsoever including without limitation, damages for loss of life, data or profits, arising out of or in any way connected with the use or performance of the Magshop Site, the delay or inability to use the Magshop Site, the provision of or failure to provide goods or services, or any information, software, products or services obtained through the Magshop Site.
14. I declare I am over 18 years of age, or I am not 18 years of age and have parental consent to make this purchase.
